ORC 5321.17:
Requires that a landlord provide a tenant in a
month-to-month tenancy with a full thirty (30) day notice to
vacate. This means that at least thirty (30) days must lapse
between the date of the notice and the date that the termination
occurs. A month-to-month agreement runs from the day rent is due
until the next rental due date. The rental agreement can only
end on the day before the rent is due. For example:
The rental due date is the fifth (5th) of the month. If your landlord provides you with a thirty (30) day notice to move on the sixth (6th) or after of October, the tenancy will not termi nate until the fourth (4th) of December. This is because at least thirty (30) days must pass from the date of the notice and that date upon which the tenancy will terminate.
After the landlord has provided an appropriate thirty (30) day notice of a change of the terms of a rental agreement, if the tenant has not agreed to the new terms of agreement or moved out, the landlord may then proceed with a three-day notice to vacate and then file for an eviction if the tenant still has not moved out.
